Probate Fees by Province & Territory

Probate court handles the authentication of wills and executors, and distributes the assets of the deceased if the will is deemed unauthentic or there is no will in place. If the deceased does not have a will, probate court is almost always necessary to settle an estate. 

 

Probate fees vary by province/territory and the estate value, however, it is an avoidable cost and inconvenience for your loved ones. In certain cases, a probate lawyer may be required which is an additional expense for the estate. Taking the extra time to go over your will and estate plan with a lawyer and financial advisor can save you the probate fees listed below. On the other hand (depending on the size of your estate), if your province or territory has little to no probate fees, additional planning to avoid probate may not be worth your time and money.
